Welcome to Autumn ABA LLC (“Autumn ABA,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our services, including our website (autumnabacare.com), communications, and ABA therapy offerings. By accessing or using our services, you agree to these Terms. If you do not agree, please do not use our services.
1. Use of Services
Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement to use our services.
Services Provided
Autumn ABA provides Applied Behavior Analysis (ABA) therapy to children with autism and related developmental disabilities. Services are delivered in-home or via telehealth when authorized.
Availability
All services are subject to therapist availability, insurance authorization, and completion of intake forms.
Prohibited Use
You agree not to use our services in any unlawful manner, or in a way that disrupts operations, breaches confidentiality, or misrepresents your eligibility.
2. Client Responsibilities
Accurate Information
You agree to provide accurate, current information during intake and throughout care, including insurance, contact, and address information.
Timely Communication
We rely on timely responses from families to ensure effective scheduling and care coordination.
Parental Involvement
Parents/guardians must be available for communication and participate in parent training when part of the treatment plan.
3. Payment Terms
Insurance Coverage
We accept Medicaid and most major insurance plans. Coverage is verified before starting services, but we cannot guarantee approval or payment by your insurance.
Financial Responsibility
You are responsible for any copayments, deductibles, or out-of-network fees not covered by your insurance provider.
Private Pay Clients
Clients without insurance coverage will be provided a private pay agreement with fee terms.
Cancellations
You must notify us at least 24 hours in advance for cancellations. Repeated or late cancellations may lead to service interruptions or fees.
4. SMS Communications and Opt-Out
By providing your mobile number, you consent to receive text messages from Autumn ABA regarding your services and scheduling.
Opt-Out
Reply “STOP” to any message to unsubscribe. You will receive a confirmation and will no longer receive texts.
Essential Messages
We may continue sending essential service messages, even if you opt out of promotional communications.
Re-Enrollment
To resume messages, reply “START” or contact our office.

6. Carrier and Message Terms
Message Rates
Message and data rates may apply. Please contact your carrier for details on your plan.
Carrier Responsibility
Mobile carriers are not liable for delayed or undelivered messages.
Privacy of Mobile Data
We never sell or share your mobile data with third parties for marketing. Your mobile information is stored securely in compliance with HIPAA and our Privacy Policy.
7. Privacy and Confidentiality

8. Limitation of Liability
To the extent allowed by law, Autumn ABA is not liable for any indirect, incidental, or consequential damages related to use of our services, including but not limited to scheduling delays, claim denials, or technical issues.
9. Changes to Terms
We may update these Terms at any time. The most current version will always be available on our website. Your continued use of our services indicates acceptance of any updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
